These Terms of Service (“Terms”) govern your access to and use of the I Want MODERN website(s) and your purchase and use of any digital products and services offered by I Want MODERN (“we”, “us”, “our”).

1) Seller details

I Want MODERN is a trading name/brand operated by Olga Grossenbacher, sole proprietor (self-employed), Switzerland.

By accessing our website, purchasing, or using any product/service, you agree to these Terms.

1) What we offer

We may offer, from time to time:

• Digital products (including templates, libraries, downloads, trainings, masterclasses, checklists, and other digital resources)

• Audits / reviews (including sales page audits or website reviews in written or live formats)

• Services (including 1:1 sessions such as “Eyes on Your Page”)

• Custom design/build services and related add-ons (when offered)

The exact scope, deliverables, pricing, and what is included/excluded are defined on the relevant sales page and checkout at the time of purchase, and those descriptions are incorporated into these Terms by reference.

2) Purchases, payment, and delivery

Payments are processed via third-party providers such as Stripe and/or checkout platforms such as ThriveCart (and any additional methods shown at checkout). We do not store full payment card details.

2.1 Digital delivery

Digital products are delivered via on-screen access and/or email. You are responsible for providing a valid email address and ensuring you can receive our emails.

2.2 Payment plans (only if offered)

If a payment plan is offered and selected, you authorize us (and our payment processor) to charge the payment method on file according to the agreed schedule. Missed payments may result in paused access/services and/or termination as described below.

3) Refunds, cancellations, and chargebacks

3.1 Digital products & digital resources — no refunds

Because digital products are delivered immediately and cannot be “returned,” all digital product purchases are final and non-refundable once access is provided.

Legal exception: We will honor any mandatory consumer rights that cannot be excluded under applicable law.

3.2 Audits and 1:1 sessions

Fees for audits and 1:1 sessions are generally non-refundable once delivered. If we cannot deliver due to genuine scheduling impossibility on our side, the specific refund rule in Section 6 applies (Eyes on Your Page).

3.3 Custom services (only if offered)

For custom services (e.g., website builds, VIP intensives), refunds are generally not available once work has begun, because time is reserved and work is customized. Any non-refundable deposits or milestone terms will be stated on the proposal/sales page/checkout for that service.

3.4 Chargebacks

If you have a billing issue, contact support@iwantmodern.com first. Unjustified chargebacks may result in immediate loss of access and we may provide evidence to the processor to dispute the chargeback.

4) Intellectual property and license

All content, designs, templates, videos, frameworks, and materials we provide are protected by intellectual property laws. You are buying a license to use, not ownership, unless stated otherwise.

4.1 Digital products — license grant

Upon purchase, we grant you a limited, non-exclusive, non-transferable, revocable license to use the digital product for your own business/internal use.

You may also use outputs for client work only in non-editable form (e.g., exported PDFs/images/video or implemented designs), provided you do not share editable files, template links, or source assets with clients or third parties.

This license is for one person / one seat unless a team/multi-seat license is explicitly sold.

4.2 Prohibited uses

You may not:

• resell, redistribute, share, publish, sublicense, gift, or make available any portion of our digital products or materials (including Canva links, editable templates, files, videos)

• upload them to shared drives, communities, marketplaces, or course libraries

• create derivative template packs or competing products substantially based on our materials

• remove copyright notices or claim authorship

Violation may result in immediate termination without refund and legal enforcement.

4.3 Custom work (if offered)

Unless otherwise stated, custom work remains our intellectual property until full payment is received. Upon full payment, you receive a non-exclusive license to use the final deliverables for your business.

4.4 Portfolio rights

Unless you request otherwise in writing, we may showcase non-confidential work (e.g., screenshots, designs, or finished pages) in our portfolio and marketing.

5) Client responsibilities (applies to services/custom work)

If you purchase a service requiring your participation or materials, you agree to:

• provide accurate information and required assets in a timely manner

• respond and approve feedback within a reasonable timeframe (typically 3 business days unless otherwise stated)

• treat us respectfully and communicate professionally

Delays in communication or missing materials may shift timelines or require rescheduling.

6) “Eyes on Your Page” — specific service terms

6.1 Description

A 1-hour private session reviewing your published sales page together. You receive prioritized design and conversion fixes (especially for mobile) and, when helpful, guidance for quick on-the-spot adjustments so you leave with clarity on exactly what to change. Live edits are limited and not guaranteed; the primary goal is direction and prioritization.

6.2 Scheduling & lead time

After payment, you will be redirected to book your session.

To protect quality and preparation time, sessions may be scheduled from fourteen (14) days after purchase. Availability is limited and varies. Purchasing the service does not guarantee a specific date or time.

6.3 Booking window

You must book and complete your session within ninety (90) days of purchase unless stated otherwise at checkout. If you do not book within this window, the session may be forfeited without refund (unless we agree otherwise in writing).

6.4 Rescheduling (48 hours)

If you need to move your session, email olga@iwantmodern.com at least 48 hours in advance. One reschedule is allowed per purchase unless we agree otherwise in writing.

6.5 No-shows / late arrival

If you do not attend or are more than 15 minutes late, the session is forfeited and considered delivered, with no refund.

6.6 If scheduling becomes genuinely impossible

If we are genuinely unable to offer any workable time slot within thirty (30) days after your first booking attempt (despite reasonable flexibility on both sides), you may request a full refund of the service fee. This applies only to genuine scheduling impossibility, not preference for specific dates/times.

6.7 Credit toward future custom build (if offered)

If stated on the sales page/checkout, the session fee may be credited toward a future custom build booked within the timeframe shown at checkout. Credits are non-transferable and not redeemable for cash.

7) Disclaimers

Our products/services are educational and informational. We do not guarantee business results, conversions, or revenue. Your results depend on many factors outside our control.

We do not provide legal, tax, financial, or medical advice.

8) Acceptable use

You may not use our website or materials for unlawful purposes, infringe intellectual property, harass others, or attempt to copy/clone our site, products, or offers.

9) Limitation of liability

To the maximum extent permitted by law:

• we are not liable for indirect, incidental, special, or consequential damages

• we are not responsible for third-party platform issues (e.g., Webflow, Stripe, ThriveCart, email providers)

• our total liability for any claim is limited to the amount paid for the specific product/service giving rise to the claim

10) Termination

We may suspend or terminate access/services if:

• payments are missed

• abusive or unlawful behavior occurs

• intellectual property is violated

• scope is violated or misuse is detected

In such cases, access may be revoked without refund, and unpaid balances (if any) may remain due.

11) Email communication & marketing consent

If you subscribe or opt in to marketing communications, we may send you emails with premium design insights, conversion strategies, product updates, and exclusive offers. You can unsubscribe at any time using the link in any email.

Important: Transactional emails (receipts, access links, booking info) are sent as necessary to fulfill purchases, even if you do not opt in to marketing.

Your personal data is handled according to our Privacy Policy.

12) Governing law

These Terms are governed by Swiss law. Disputes shall be resolved under the jurisdiction of Lausanne, Switzerland, subject to any mandatory consumer protections that apply in your country.

13) Changes to these Terms

We may update these Terms from time to time. The version in effect at the time of your purchase applies to that purchase.
